Welcome to the website of the Metropolitan Montreal Basketball Referee Association (MMBRA).

These Terms & Conditions govern access to and use of the MMBRA website, online services, forms, member resources, and other features made available through the website.

By accessing or using the MMBRA website, you agree to comply with these Terms & Conditions and all applicable laws and regulations. If you do not agree with these Terms & Conditions, you should not use the website or its services.

These Terms & Conditions should be read together with the MMBRA Privacy Policy, which explains how MMBRA collects, uses, discloses, and protects personal information.

1. About MMBRA

The Metropolitan Montreal Basketball Referee Association (MMBRA) is a basketball officiating association serving the Montreal metropolitan region.

MMBRA provides resources, information, education, recruitment opportunities, officiating activities, events, communications, and other services to support basketball officials and the basketball community.

MMBRA does not maintain a physical office. MMBRA can be contacted using the contact information provided at the end of these Terms & Conditions.

2. Use of the Website

The MMBRA website is provided to make information, resources, forms, services, and communications available to members, officials, applicants, participants, and the general public.

You agree to use the website only for lawful purposes and in a manner that does not:

  • Violate any applicable law or regulation;

  • Infringe the rights of MMBRA or another person or organization;

  • Interfere with the operation or security of the website;

  • Attempt to gain unauthorized access to restricted areas or accounts;

  • Introduce malicious software, code, or other harmful material;

  • Use automated systems or methods to access, scrape, copy, or collect website content without authorization; or

  • Misrepresent your identity or affiliation with MMBRA or another organization.

MMBRA may restrict or suspend access to portions of the website where reasonably necessary to protect the website, its users, its information, or its operations.

3. Website Information and Accuracy

MMBRA makes reasonable efforts to provide information that is accurate and current.

However, information published on the website may change and may not always be complete, current, or free from errors.

Information concerning games, assignments, clinics, tournaments, events, educational materials, deadlines, eligibility, registration, or other activities may be changed, corrected, postponed, or cancelled without notice where circumstances require.

MMBRA does not guarantee that all website information will always be complete, accurate, current, or available.

Users should confirm important information directly with MMBRA or the relevant governing organization where appropriate.

4. Referee Registration and Membership

Certain MMBRA services may be available only to individuals who meet applicable membership, registration, certification, eligibility, or other requirements.

Submitting a registration or application through the website does not automatically guarantee membership, acceptance, assignment, certification, participation, or appointment.

MMBRA may review applications and registrations and may require additional information or documentation where reasonably necessary to administer its programs and activities.

Participation in MMBRA activities may also be subject to applicable rules, policies, procedures, eligibility requirements, and decisions established by MMBRA, Basketball Québec, the Canadian Basketball Officials Commission (CBOC), leagues, competition organizers, or other applicable governing organizations.

5. Member Accounts and Restricted Access

Certain areas or services of the MMBRA website may require a login, registration, or other form of authorization.

Where an account or login is provided, you are responsible for:

  • Providing accurate information;

  • Maintaining the confidentiality of your login credentials;

  • Taking reasonable steps to protect your account;

  • Not sharing your credentials with unauthorized individuals; and

  • Promptly notifying MMBRA if you believe your account or credentials have been compromised.

MMBRA may suspend, restrict, or terminate access to an account or restricted service where it reasonably believes that the account has been misused, compromised, or used in violation of these Terms & Conditions or applicable policies.

6. Website Forms and Online Submissions

MMBRA provides various online forms and services, which may include:

  • Contact Us;

  • Become a Referee;

  • Ask a Referee;

  • Incident Report; and

  • Shop-related services.

Information submitted through these services must be accurate and provided for a legitimate purpose.

You agree not to submit false, misleading, fraudulent, abusive, threatening, or otherwise inappropriate information.

MMBRA may review, respond to, retain, or otherwise process submissions as reasonably necessary to administer the relevant service or activity and in accordance with the MMBRA Privacy Policy and applicable law.

Submitting an incident report, question, application, or other form does not guarantee a particular response, decision, outcome, assignment, investigation, or action by MMBRA.

7. Ask a Referee and Educational Information

MMBRA may provide educational information, explanations of basketball rules, interpretations, officiating resources, videos, documents, and responses to questions submitted through the website.

Educational information is provided for informational and educational purposes and may depend on the specific competition, ruleset, interpretation, and circumstances of a particular situation.

Official basketball rules, interpretations, competition regulations, league rules, and applicable governing-body policies take precedence where applicable.

MMBRA does not guarantee that information provided through an educational resource or response will constitute an official ruling for a particular competition or game.

8. Incident Reports

MMBRA may provide an online Incident Report service for reporting matters relating to games, officials, participants, or other MMBRA-related activities.

Incident reports should be submitted honestly, accurately, and in good faith.

Submitting an incident report does not guarantee that MMBRA will take a particular action or disclose the outcome of any review.

MMBRA may restrict access to incident reports and related information where appropriate due to privacy, confidentiality, administrative, disciplinary, or legal considerations.

9. MMBRA Shop

MMBRA may make referee-related products, apparel, equipment, documents, or other items available through its website.

Availability, pricing, product descriptions, and other information may change without notice.

The MMBRA website does not process online credit card, debit card, banking, or other online payment information for MMBRA Shop purchases.

Where purchases or other amounts are applicable to MMBRA referees, the applicable amount may be deducted from referee cheques rather than collected through online payment processing.

MMBRA may limit quantities, correct pricing or product information errors, or discontinue products or services where reasonably necessary.

Any applicable purchase, distribution, return, or exchange conditions may also be communicated separately for a particular product or service.

10. Events, Clinics, Camps, and Activities

MMBRA may organize or promote clinics, camps, recruitment activities, tournaments, educational sessions, social events, meetings, and other activities.

Participation may be subject to registration requirements, eligibility requirements, capacity limits, schedules, fees, location requirements, or other conditions communicated for the specific activity.

MMBRA reserves the right to modify, postpone, relocate, or cancel an activity when reasonably necessary.

Specific event information and registration conditions may supplement these Terms & Conditions.

11. Photography and Video

MMBRA may photograph or record video during MMBRA games, clinics, recruitment activities, educational sessions, tournaments, award ceremonies, social events, and other MMBRA-related activities.

Photographs and videos may be used for legitimate MMBRA purposes, including communications, education, promotion of basketball officiating, recognition of officials, documentation of activities, and organizational promotion.

Images or recordings may be published through the MMBRA website, social media platforms, newsletters, and other MMBRA communications.

By participating in an MMBRA activity or event, individuals acknowledge that photography and video recording may take place.

12. Intellectual Property

Unless otherwise indicated, content made available through the MMBRA website, including text, logos, graphics, photographs, videos, documents, educational materials, designs, and other original materials, is owned by MMBRA or used by MMBRA with permission.

MMBRA's name, logos, branding, and other identifying materials may not be used without appropriate authorization.

You may access and use publicly available MMBRA content for personal, non-commercial, and informational purposes, provided that the content is not altered, misrepresented, or presented as your own.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or otherwise reuse MMBRA content without prior authorization, except where permitted by applicable law.

Third-party materials remain the property of their respective owners and may be subject to additional terms or restrictions.

13. User-Submitted Content

Users may submit questions, comments, reports, photographs, documents, or other content through MMBRA services.

You remain responsible for the content you submit and must have the right to provide that content to MMBRA.

You agree not to submit content that is unlawful, fraudulent, defamatory, threatening, abusive, discriminatory, misleading, or that infringes the rights of another person or organization.

By submitting content to MMBRA, you authorize MMBRA to use the submission as reasonably necessary to provide the service for which it was submitted, administer MMBRA activities, communicate with you, investigate relevant matters, or otherwise fulfill legitimate organizational purposes, subject to applicable law and the MMBRA Privacy Policy.

MMBRA does not claim ownership of personal information merely because it is submitted through an MMBRA service.

14. Third-Party Websites and Services

The MMBRA website may contain links to or integrate with third-party websites, platforms, or services.

These may include services used for referee assignments, communications, registration, education, social media, website analytics, or other MMBRA activities.

Third-party services may include, among others:

  • ArbiterSports;

  • Mailchimp;

  • Wix;

  • CBOC or Basketball Québec resources;

  • Social media platforms; and

  • Other organizations or service providers used by MMBRA.

Third-party websites and services operate independently from MMBRA and may have their own terms, conditions, privacy policies, and practices.

MMBRA is not responsible for the content, availability, security, privacy practices, or policies of third-party websites or services.

Users should review the applicable terms and privacy policies before using third-party services or providing information to them.

15. Referee Assignments and ArbiterSports

MMBRA uses ArbiterSports to administer referee assignments and related officiating activities.

Assignment information, availability, scheduling information, and other officiating-related information may be managed through ArbiterSports.

Referee assignments are subject to MMBRA assignment procedures and applicable competition requirements.

The appearance of an assignment, availability request, or other information within a third-party system does not alter MMBRA's authority to administer assignments or make changes where reasonably necessary.

MMBRA is not responsible for technical problems, outages, errors, or other issues originating from third-party assignment platforms.

16. Communications

MMBRA may communicate with members, officials, applicants, volunteers, and other individuals by email or other communication methods for organizational, administrative, educational, operational, or informational purposes.

Certain communications may be necessary for participation in MMBRA activities or for the administration of membership and officiating activities.

Optional communications may include newsletters, announcements, promotional information, event information, and other updates.

Information concerning email communications and Mailchimp is addressed further in the MMBRA Privacy Policy.

17. Prohibited Activities

Users may not use the MMBRA website or services to:

  • Violate applicable laws or regulations;

  • Impersonate another person or organization;

  • Provide false or misleading information;

  • Attempt to gain unauthorized access to accounts, systems, or restricted content;

  • Interfere with the website or its security;

  • Upload or transmit malicious software;

  • Collect information from the website through unauthorized automated means;

  • Copy or distribute protected content without authorization;

  • Harass, threaten, abuse, or intimidate other users or MMBRA representatives;

  • Submit fraudulent or intentionally misleading reports or applications; or

  • Use MMBRA services for an unauthorized commercial purpose.

MMBRA may take reasonable action in response to prohibited activities, including restricting access to website services or referring matters to appropriate authorities where required or appropriate.

18. Website Availability and Security

MMBRA makes reasonable efforts to maintain the availability and security of its website.

However, MMBRA does not guarantee that the website will always be available, uninterrupted, secure, error-free, or free from viruses or other harmful components.

The website may occasionally be unavailable because of maintenance, technical issues, updates, third-party service interruptions, or circumstances beyond MMBRA's reasonable control.

Users are responsible for maintaining appropriate security on the devices and networks they use to access the website.

19. Disclaimer

The MMBRA website and its content are provided for general informational and organizational purposes.

To the extent permitted by applicable law, MMBRA makes no representations or warranties that:

  • The website will always be available;

  • Website content will always be complete, accurate, or current;

  • The website will operate without interruption or error;

  • Information will always be suitable for a particular purpose; or

  • Third-party websites or services will be available, accurate, secure, or reliable.

Nothing in these Terms & Conditions excludes or limits any rights, warranties, or protections that cannot legally be excluded or limited under applicable law.

20. Limitation of Liability

To the extent permitted by applicable law, MMBRA and its directors, officers, representatives, volunteers, and authorized personnel will not be responsible for losses or damages arising from:

  • Use of or inability to use the website;

  • Reliance on information published on the website;

  • Errors, omissions, or inaccuracies in website content;

  • Temporary or permanent unavailability of the website;

  • Problems involving third-party websites, platforms, or services;

  • Unauthorized access resulting from circumstances outside MMBRA's reasonable control; or

  • Other matters arising from the use of the website or its services.

Nothing in these Terms & Conditions is intended to exclude liability where such exclusion is prohibited by applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable expenses arising from your unlawful or unauthorized use of the MMBRA website or services, your violation of these Terms & Conditions, or your infringement of the rights of MMBRA or another person or organization.

This provision does not apply to the extent that such responsibility cannot legally be imposed under applicable law.

22. Suspension or Termination of Access

MMBRA may suspend, restrict, or terminate access to the website or particular services where reasonably necessary, including where a user:

  • Violates these Terms & Conditions;

  • Misuses an MMBRA service;

  • Attempts to compromise the security of the website;

  • Provides fraudulent or misleading information; or

  • Engages in conduct that may harm MMBRA, its members, officials, participants, or other users.

MMBRA may also modify or discontinue website services where reasonably necessary for operational, technical, organizational, or other legitimate reasons.

Termination or restriction of website access does not affect rights or obligations that arose before the termination or restriction.

23. Privacy

MMBRA's collection, use, disclosure, retention, and protection of personal information are governed by the MMBRA Privacy Policy and applicable privacy legislation.

The Privacy Policy forms an important part of MMBRA's website governance and should be reviewed together with these Terms & Conditions.

24. Changes to These Terms & Conditions

MMBRA may update these Terms & Conditions from time to time to reflect changes in its website, services, activities, technology, organizational practices, or legal requirements.

When material changes are made, MMBRA will provide appropriate notice through the website or other reasonable communication methods where appropriate.

The effective date at the beginning of these Terms & Conditions indicates when the current version took effect.

Changes will not automatically apply retroactively to matters that occurred before the revised Terms & Conditions took effect unless permitted or required by applicable law.

25. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.

The remaining provisions will continue to apply to the extent permitted by law.

26. No Waiver

If MMBRA does not immediately enforce a provision of these Terms & Conditions, that does not mean MMBRA has waived its right to enforce that provision later.

Any waiver by MMBRA must be made in accordance with applicable law.

27. Governing Law

These Terms & Conditions are governed by the laws applicable in the Province of Quebec and the applicable laws of Canada.

Any dispute relating to these Terms & Conditions or the use of the MMBRA website will be subject to the jurisdiction of the applicable courts of Quebec, unless otherwise required by applicable law.

28. Entire Agreement

These Terms & Conditions, together with the MMBRA Privacy Policy and any additional terms or policies expressly applicable to a particular MMBRA service or activity, constitute the terms governing your use of the MMBRA website and its online services.

Where specific terms apply to a particular service, event, registration, or activity, those terms may supplement these Terms & Conditions.
